This data privacy security declaration applies only to Nextbitt services.

Scope of Application
This Policy covers the processing, by automated or non-automated means, of all personal data, including the processing of special categories of personal data, carried out by Nextbitt as the Controller.
All personal data relating to special categories of personal data will be processed with increased diligence by Nextbitt. Both categories will also be referred to as "Personal Data" in this Policy unless otherwise stated.
Privacy and Protection of Personal Data
a. Processing Operations on your Personal Data
In accordance with data protection legislation, your Personal Data are processed, by Nextbitt:
- in a lawful, fair and transparent manner;
- for specified, explicit and legitimate purposes
- in an appropriate manner, relevant and limited to what is necessary for the purposes of their treatment;
- taking into account their accuracy and their updating whenever necessary;
- being kept only for as long as necessary for the purposes of their processing
- and in a way that ensures its security.
Nextbitt may share the Personal Data of Data Subjects with Subcontractors provided that it is necessary for the normal provision of its services.
The relationship established between Nextbitt and the Subcontractors is, under the terms of the data protection legislation in force, regulated by a contract that binds the Subcontractor to Nextbitt, establishing, regarding Personal Data, the object, duration, nature and purpose of its processing, the type of personal data and the categories of data subjects, as well as Nextbitt's obligations and rights.
The same contract also stipulates the obligations of the Subcontractor referred to in the General Data Protection Regulation (Regulation EU 2016/679 of the European Parliament and of the Council of 27 April 2016).
b. Purposes and grounds for lawfulness of the Personal Data Processing operations of:
Nextbitt carries out processing operations in respect of its Personal Data Customers to ensure compliance with the contract for the provision of services agreed with the Data Subjects or with the Joint Controllers (in respect of the data and Data Subjects collected by them, such as counterparties, employees and others). The Personal Data identified herein and subject to processing operations are under a situation of necessity for the performance of a contract, for pre-contractual steps, for compliance with legal obligations, or, in the case of marketing, may be under consent.
Personal Data will be processed in an appropriate manner insofar as they are necessary for important public interest reasons such as the prevention of money laundering and terrorist financing, in compliance with applicable legal obligations, or, where necessary, upon explicit consent of the Data Subject.
c. Sharing of your Personal Data with the following Recipients:
- NextBITT's service providers, namely in the areas of IT, technical and operational support;
- Entities of the NextBITT Group or related to them;
- Judicial Organs, Criminal Police Organs and Administrative Authorities.
d. Conservation of Personal Data
Nextbitt keeps Personal Data for the period deemed necessary and sufficient for the purposes that motivated its treatment, varying the period of time of conservation of Personal Data according to the purpose for which such Personal Data are subject to treatment, and also in accordance with the applicable legal rules on the legal periods of conservation of Personal Data.
Upon expiry of such periods, Personal Data shall be deleted, subject to appropriate technical and functional safeguards, as documented in each of the relevant processes.
e. Rights of Data Subjects
Data subjects have the right of access to Personal Data concerning them, as well as the right to rectification or erasure, the right to restriction of processing, the right to object to processing, and the right to portability of their Personal Data.
Data subjects also have the right to withdraw their consent at any time if the processing in question is based on consent given; as well as the right to lodge a complaint with the supervisory authority, Comissão Nacional de Proteção de Dados.
